Terms of Sale

These Terms of Sale have been carefully reviewed and approved by professional lawyers.


General

Any acquisition of products or services offered by TAP electro-acoustique therefore entails full and complete acceptance by the customer of all the terms listed in these Terms of Sale, which he will have previously we acknowledged.

These Terms of Sale apply in the context of a direct sale between TAP electro-acoustique and a customer, whether private or professional.

If a TAP electro-acoustique product is sold through the intermediary of another professional, the latter’s own Terms of Sale shall then prevail.
In the absence of a clear rule on a particular point, these Terms of Sale may apply.


As a musical instrument, our speakers are designed and manufactured with care, in an artisanal way. Each of them benefits from a precise assembly and tuning.

The loudspeakers are installed on the cabinet using jigs, the sealing of the assembly is ensured by materials with specific properties.

Each screw is manually tightened to a very specific torque, and braked with thread lock.

Any dismantling of a single element inevitably leads to breaking this precious balance and detuning the speaker.

Only TAP electro-acoustique or the services authorized by our brand are able to intervene on our products, including outside of their warranty coverage period.

Preamble

As such, these Terms of Sale must be applied according to each individual context, adapted to each customer, according to the cases mentioned in these Terms of Sale.

TAP electro-acoustique continually pursues a policy of improvement and development of its products, certain criteria of which are subject to change without notice.

Definition of a standard product

A “standard product” is an article or a set of items that cannot be separated for sale, a service or a set of services that cannot be separated for sale, established according to the exclusive design and manufacturing criteria specific to TAP electro-acoustique.

The standard products offered by TAP electro-acoustique are produced in accordance with the rules of the art, with carefully chosen quality components.

A standard product cannot be modified as is.
Any request for modification of a standard product will necessarily make it a personalized product.

Definition of a personalized product

A “personalized product” is considered to be an item or a set of non-separable items for sale, a service or a set of non-separable services for sale, designed and produced by TAP electro-acoustique but incorporating certain criteria defined by the customer.

TAP electro-acoustique may decide not to respond to a request for a personalized product that does not correspond to its ethics.

On a personalized product, the customer can choose certain components and/or finishes, be assisted in his choices by TAP electro-acoustique.

After approval by TAP electro-acoustique, if the customer provides parts for the realization of his project, he is then the ONLY guarantor of their quality and of the final result obtained as a result.

The products and services offered are carried out in accordance with the rules of the art, but with certain elements or finishes chosen by the customer, who remains the SOLE guarantor of the final product rendering.

Made-to-measure (personalized) products, Studies, Optimizations, Expertises, Measures or any other specific request from the customer fall within this definition criterion.

Repairs and/or Restorations desired by the customer deviating from the original product are also considered as a personalized product.


Conditions of sale

Conditions of sale of a standard product

The so-called “standard” product is accepted as is and with full knowledge of the facts by the customer, according to the indications given on its article or catalog sheet, including its price and any transport costs or additional taxes.

Full payment for the standard product, its packaging costs, transport costs and any taxes is due before or on actual delivery of the equipment.

A detailed and dated invoice will be published and will serve as proof of purchase, triggering the start of the warranty period for the standard product.

In the event of non-payment, partial or complete, TAP electro-acoustique reserves the right not to deliver the equipment, to initiate the necessary proceedings to recover the full payment if the equipment has already been delivered or services already performed, or to demand the return thereof against reimbursement of the sums already collected.

Any costs incurred by TAP electro-acoustique for a recourse of payment ARE THE CHARGE OF THE CUSTOMER.

TAP electro-acoustique declines all responsibility in the event of damage during transport of the material returned by the customer. The latter will then have to deal directly with the carrier involved.

Conditions of sale of a personalized product

Reminders:

On a personalized product, the customer can choose certain components and/or finishes, be assisted by TAP electro-acoustique in his choices.

After approval by TAP electro-acoustique, the customer can if he wishes to provide parts entering into the realization of his project, in this case he is the SOLE guarantor of their quality and of the final result obtained as a result.

The realization of a personalized product must meet the following conditions:

  • Acceptance by TAP electro-acoustique of the project initiated by the customer.
  • The customer’s agreement following the quotation proposed for the realization of his personalized product project. This same estimate can be revised 2 (two) times, depending on the customer’s needs.
  • The financing by the customer of the purchase of parts and raw materials necessary for the manufacture of his personalized product project.
  • The effective payment of at least 50% (fifty percent) of the price of labor, covering the establishment of the plans and calculations necessary for the successful completion of its personalized product project.

Full payment for the personalized product, its packaging costs, transport costs and any taxes is due before or upon actual delivery of the material.

A detailed and dated invoice will be issued and will serve as proof of purchase, triggering the start of the warranty period for the personalized product.

In the event of non-payment, partial or complete, TAP electro-acoustique reserves the right not to deliver the equipment, to initiate the necessary proceedings to recover the full payment if the equipment has already been delivered or services already performed, or to demand the return thereof against reimbursement of the sums already collected.

Any costs incurred by TAP electro-acoustique for a recourse of payment ARE THE CHARGE OF THE CUSTOMER.

Order

A detailed and dated invoice will be edited and sent to the customer. This will serve as proof of purchase, triggering the start of the product warranty period.

Full payment or the remainder of the invoice is due before or upon actual delivery of the equipment or service.

In the event of non-payment, partial or complete, TAP electro-acoustique reserves the right not to deliver the equipment, to initiate the necessary proceedings to recover the full payment if the equipment has already been delivered or services already performed, or to demand the return thereof against reimbursement of the sums already collected.

Any costs incurred by TAP electro-acoustique for a recourse of payment ARE THE CHARGE OF THE CUSTOMER.

Completion time

TAP electro-acoustique products are partly made to order, so a minimum manufacturing time is imposed.

This manufacturing time can be clearly indicated on the site, or be sent individually to a customer wishing to place an order.

Payment methods

We prefer to opt for electronic payment methods (bank transfer and PayPal).

Quote

The quote is billable according to the price list for services in force at the time of its establishment. The same estimate can be revised 2 (two) times.

The quote is valid for 1 (one) month from the date it appears.

An advance of AT LEAST 50% (fifty percent) of the total amount will be requested from the customer upon acceptance of the quote to trigger the order.

If at the end of the quotation the customer does NOT wish to place an order, he will have to pay the amount of the quotation.

A manual Invoice or Receipt may be established, specifying the amount due.

If material has been deposited with TAP electro-acoustique, this amount will be payable against its return.

In this case, an advance of the TOTAL PRICE of parts and raw materials, and AT LEAST 50% (fifty percent) of the price of labor will be requested from the customer upon acceptance of the quote to start the planned work.

Prices

The prices of the products or services offered by TAP electro-acoustique are mentioned on the site or in the price tables independent of these Terms of Sale.

The applicable price is that in effect at the time of the sale.

TAP electro-acoustique MAKES NO CREDIT.

Support for hardware

When establishing an estimate for repair, optimization, expertise or any other request from the customer, the latter may entrust his equipment to TAP electro-acoustique.

In return, he will receive PROOF OF TAKING CHARGE OF THE EQUIPMENT on which will be mentioned all the information related to his equipment, and the indications relating to the service to be performed.

Delivery

Delivery can be done in several ways:

  • removal of the material by the customer at TAP electro-acoustique: no additional costs
  • delivery by a carrier: shipping costs are billable according to the rates indicated by the carrier, depending on the weight, size and market value of the material
  • delivery by TAP electro-acoustique to the address indicated by the customer: costs are billable depending on the size, weight and distance to be traveled between TAP electro-acoustique and the delivery address.

At the time of delivery, in order for the product to be deposited, the customer will have to pay the full amount of the invoices, if he has not already done so.

The customer must sign a delivery slip attesting to the condition of the material delivered. In the miss of a delivery note, the invoice may serve as proof of delivery of the equipment.

The invoice can be given to the customer separately from the material.
The copy of the invoice issued to the customer will serve as a guarantee certificate.

Withdrawal period, return of a product

A customer has the possibility of canceling an order within a legal withdrawal period of 14 (fourteen) days.
The date indicated on the documents issued proof (order form or delivery form, deposit invoice or final invoice).

If the equipment is already delivered, the customer will have to return it at his expense to TAP electro-acoustique in an appropriate mode of transport.

The item must be in PERFECT CONDITION and returned COMPLETE, accompanied by ALL of its ORIGINAL accessories and documentation, and conditioned in its ORIGINAL PACKAGING.

Otherwise a discount will be applied to the amount refunded, depending on the condition and completeness of the equipment, its accessories, its documentation and its original packaging.

PLEASE NOTE: AESTHETIC discounts and ELECTRICAL discounts can be added together. As soon as a product leaves TAP electro-acoustique and is returned beyond the legal deadline of 14 (fourteen) days, IT LOSES 15% (fifteen percent) OF ITS INITIAL VALUE even never unpacked, and subject to of additional discounts in the event of damage observed on its packaging.

The customer will take care to condition the returned material as well as possible and to insure it according to its size, weight and value.

The costs of packaging and transport for returning the material are the responsibility of the customer. The products remain under its full responsibility until the good reception by TAP electro-acoustique.

TAP electro-acoustique declines all responsibility in the event of damage during transport of the material returned by the customer. The latter will then have to deal directly with the carrier involved.

In return, TAP electro-acoustique will offer a VOUCHER for the amount to be reimbursed, valid for 1 (one) year from the date shown. After this date, the credit will no longer be admissible and its market value will in no way be payable to TAP electro-acoustique.

ANY PRODUCT RECEIVED DETERIOR, INCOMPLETE OR PRESENTING TRACES OF DISASSEMBLY (OR ATTEMPTED) WILL NOT BE REFUNDED IN ITS FULL.


Warranty

General warranty conditions

Only TAP electro-acoustique or the services authorized by our brand are able to intervene on our products, including outside the coverage period of their warranty.

Our speakers are intended FOR DOMESTIC LISTENING with high-end high-fidelity equipment, and not for any form of sound system, whether private or public.

Professional STUDIO-type applications are also compatible with our speakers, as long as the settings of the amplification systems respect their nominal power and do not clip.

ANY BREACH OF COMPLIANCE WITH THE RULES FOR THE USE OF A PRODUCT AS DESCRIBED IN ITS PAGE, ITS ARTICLE SHEET OR ITS CATALOG RESULTS IN THE CANCELLATION OF ITS WARRANTY.

Warranty applicable to a standard product

TAP electro-acoustique reserves the right to assess the material in question before any intervention and assumption of the guarantee.

In the event that the warranty is NOT applicable, appraisal costs may be claimed from the customer, according to the price list for services in force at the time of the appraisal.

Warranty applicable to a personalized product

TAP electro-acoustique reserves the right to assess the material in question before any intervention and assumption of the guarantee.

In the event that the warranty is NOT applicable, appraisal costs may be claimed from the customer, according to the price list for services in force at the time of the appraisal.

Warranty exclusion clauses

Are EXCLUDED FROM THE WARRANTY of our products:

  • Any form of use OTHER THAN DOMESTIC or professional STUDIO-type, as recommended on the page, the item sheet or the catalog of our products.
  • Use of the speakers with port(s) blocked, even partially.
  • Any intervention, even minor, by an individual or a professional other than by our brand staff or duly recognized by our services.
  • The parts supplied by the customer as part of the realization of a personalized project.
  • Aesthetic defects resulting from improper use or handling, improper storage by the customer after delivery or improper transport of the products, except transport by TAP electro-acoustique, namely in particular:
     
    • non-electrical components of the enclosure defective by exposure to abnormally high humidity or unsuitable temperature
    • dismantling (or attempt), drilling, blows, detachments, marks, traces, stains, discoloration or lack of parts on the cabinetry, the casing or the coating of the products
    • disassembly (or attempt), holes, tears, blows, detachments, marks, traces, stains, discoloration, or lack on items identified as speaker accessories (adjustment buttons or jumpers, cables, connection terminals or connection means, screws or fixing means , grids or covers, sheaths or protective element, fabrics, logos, supports, decoupling points, original packaging, etc…)
    • disassembly (or attempt), holes, tears, knocks, detachments, marks, traces, stains, discoloration or lack on the speakers, membranes, surrounds or speaker dust caps
    • removal or degradation of an identification label or an original TAP electro-acoustique plate
    • any mechanical transformation, replacement of one or more original elements of the TAP electro-acoustique product.
  • Electrical faults resulting from improper use or handling, improper storage by the customer after delivery or improper transport of the products, except transport by TAP electro-acoustique, namely in particular:
     
    • any electrical element, loudspeaker defective by being subjected to an abnormally high level of humidity or an unsuitable temperature
    • any electrical element, defective loudspeaker due to the sending of excessive power not suitable for the normal use provided for in the item sheet or in the product catalog, coil/tape cut or not for the loudspeakers (disproportionate amplifier, misused or pushed to saturation, presence of Direct Current, use of an equalizer or a sound processor, modification of the signal by adjustment of Tone/Contour/Loudness or other process aimed at distorting the linearity of the signals)
    • connection of products to inappropriate, incompatible or defective equipment (NOT high-fidelity equipment, presenting operating faults or failures, even random)
    • any electrical transformation, even minor, replacement of one or more original components of the TAP electro-acoustique product
    • possibly: any use that does not comply with the recommendations indicated by the manufacturers of the constituent elements of TAP electro-acoustique products, certain particular characteristics of which may, if necessary, appear on the item sheet or the catalog of TAP electro-acoustique products.

Special cases

Each warranty claim will be examined on a case-by-case basis, depending on the client’s findings and the conclusions of TAP electro-acoustique or the manufacturer of the part in question.
The goal is to best satisfy the customer and prevent a failure of the same nature from occurring.

The warranty is applicable to original TAP electro-acoustique products as well as to those resold by TAP electro-acoustique, acquired as part of a recovery or restoration.

When an original part supposedly defective is no longer available (by obsolescence or unavailability from the manufacturer of the article), TAP electro-acoustique reserves the right to replace it with an equivalent part with similar performance, and to carry out any small adjustments necessary for the correct functioning of the product.
In this case, the customer will be informed before the intervention on his equipment.

For the rare cases where very important modifications are necessary (adaptation of a loudspeaker with different dimensions leading to retouching the cabinet, creation of a new filtering system very different from the original, etc …), the customer will be consulted before these major modifications of the product, and will give or not his agreement to carry out them.

Some of these significant changes may be chargeable, even if the product is covered by its warranty. The customer will be informed and will give their consent or not to carry out this work to upgrade the original product.

Support for a product under warranty

If a product is returned during its warranty period, the item must be returned COMPLETE, accompanied by ALL of its original accessories, and packaged as far as possible in its ORIGINAL PACKAGING.

The costs of packaging and transport for returning the supposedly defective equipment are the responsibility of the customer. The customer will take care to condition the returned material as well as possible and to insure it according to its size, weight and value. The products remain under its full responsibility until the good reception by TAP electro-acoustique.

TAP electro-acoustique declines all responsibility in the event of damage during transport of the material returned by the customer. The latter will then have to deal directly with the carrier involved.

ANY PRODUCT RECEIVED DETERIORED WILL NOT BE COVERED UNDER ITS WARRANTY.

Extended warranty

In this case, the warranty period for the product concerned will appear clearly on its item file, on the product catalog or on the invoice given to the customer.


Property

General conditions of ownership

THE PRODUCTS OR SERVICES PROVIDED BY TAP ELECTRO-ACOUSTIQUE REMAIN ITS EXCLUSIVE AND TOTAL PROPERTY UNTIL THE CUSTOMER HAS NOT PAY ALL OF THE SUMS DUE.

Intellectual property

TAP electro-acoustique is a registered French trademark.
Our products offered for sale are also registered.

On a PRODUCT or DOCUMENT supplied by TAP electro-acoustique, covered or not by its warranty period, intellectual property remains.

Anyone in the presence of a TAP electro-acoustique product or document must under no circumstances and in any form whatsoever, copy, reproduce or disclose, even partially, the manufacturing processes of the products or the content of the products TAP electro-acoustique documents not distributed to the public of which they may be aware.

In the event of a proven copy or infringement, TAP electro-acoustique reserves the right to initiate the necessary proceedings against the perpetrator(s) of the serious offense.
